1.    Acceptance of Terms

By accessing, downloading, or using the POLappka mobile application and services provided by "Long Neck Family Labs," you, the user, acknowledge and agree to be unconditionally bound by these Terms and Conditions (the "Terms") and our Privacy Policy, which is incorporated herein by reference. These Terms are a legally binding contract between you and "Long Neck Family Labs," governing your use of the POLappka application and any available services or content.
Your agreement to these Terms also extends to any updates, modifications, or additional features that may be introduced to POLappka, subject to your continued right to participate under these Terms. •    Notify "Long Neck Family Labs" immediately upon discovering any unauthorised use of your account or any other security breach. Notification can be made through the contact information provided within these Terms or the application's designated reporting mechanisms.
"Long Neck Family Labs" will not be liable for any loss or damage arising from your failure to comply with these security obligations. You may be held responsible for losses incurred by "Long Neck Family Labs" or any other user of POLappka due to someone else using your account due to your failure to keep your account information secure and confidential.
In any dispute regarding account ownership, "Long Neck Family Labs" reserves the right to determine account ownership based on its reasonable judgment, considering various factors such as the registration data, transaction history, and account activity.
The security and integrity of user accounts are paramount to us. By adhering to these registration and security protocols, you contribute to the safe and effective operation of POLappka, ensuring a positive user experience.
3.    User-Generated Content & Community Standards
The POLappka platform empowers users to generate, share, and post a wide range of content, including advertisements, comments, messages, and multimedia, collectively known as "User-Generated Content." To ensure a respectful, lawful, and safe environment for all users, we establish comprehensive guidelines governing the submission, management, and moderation of User-Generated Content.
3.1.    Content Responsibility and Standards
Users are responsible for any User-Generated Content they post on POLappka, including its accuracy, legality, and appropriateness. You acknowledge and accept all risks associated with your content, including its reliance upon and exposure to third parties, along with any consequences arising from sharing such content. POLappka and Long Neck Family Labs do not endorse, support, represent, or guarantee any User-Generated Content's completeness, truthfulness, accuracy, or reliability. Moreover, the views expressed by users do not reflect the official policy or position of Long Neck Family Labs. The user is responsible for ensuring that content does not infringe on others' rights, including privacy, copyright, and trademark laws, and adheres to UK laws and regulations. Content must not be defamatory, obscene, offensive, or unlawful.
3.2.    Rights to Content and Moderation Practices
By posting content on POLappka, you confirm that you own the content or have obtained all necessary licenses, rights, consents, and permissions to authorise POLappka to display, distribute, and reproduce such content. Long Neck Family Labs reserves the right, but not the obligation, to review, monitor, edit, or remove User-Generated Content at any time for any reason, including content that violates these terms or may harm or threaten the safety of users.
3.3.    Exposure to Inappropriate Content and User Reporting
Despite our efforts to moderate content, users may occasionally encounter offensive, inappropriate, or objectionable material. Long Neck Family Labs cannot be held liable for any damages, distress, or harm caused by exposure to such content. Excluding User-Generated Content, "Long Neck Family Labs" owns or has the rights to all the intellectual property in the POLappka service. This encompasses the content explicitly produced and made available by "Long Neck Family Labs" and the underlying software, technology, and infrastructure designed to deliver the service.
4.2.    User License
When you submit, post, or display User-Generated Content on or through POLappka, you grant "Long Neck Family Labs" a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any media or distribution methods now known or later developed. This license enables "Long Neck Family Labs" to operate, promote, and improve the POLappka service and create new ones. This license continues even if you stop using our service, but it is limited to the necessary duration and scope for the operation and promotion of the service.
Without your explicit permission, this license does not grant "Long Neck Family Labs" any rights to sell or distribute your content outside of POLappka services. Unless otherwise agreed in writing, it also does not affect your rights to your User-Generated Content, including the right to grant additional licenses.
You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any content you submit. This includes ensuring that your content does not infringe or violate any third party's intellectual property or other rights.
By posting content to POLappka, you also grant other users of the application a non-exclusive license to access your User-Generated Content through the service and to use, reproduce, distribute, display, and perform such Content as permitted through the functionality of the service and under these Terms.
These intellectual property provisions are designed to clarify the ownership and use of content within POLappka, protecting the rights of both "Long Neck Family Labs" and our users. It ensures that the service can continue to provide value to users while respecting the legal rights of all content creators and owners.
5.    Service Use
The POLappka platform, provided by "Long Neck Family Labs," is designed to offer all users a secure, reliable, and positive experience. To ensure this, users must adhere to specific standards of conduct regarding the lawful and ethical use of the service. Below are expanded guidelines detailing the expectations for all users regarding legal use and prohibited actions.

This includes but is not limited to, activities related to fraud, theft, or invasion of privacy. •    Introduction of Malicious Software: You must not upload, distribute, or otherwise introduce into the service any viruses, worms, malware, Trojan horses, time bombs, or any other malicious software or harmful technologies that could damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
•    Technological Harm: Engaging in activities that are harmful to the service, such as hacking, password mining, or any other means of gaining unauthorised access to the service, other accounts, computer systems, or networks connected to the service through hacking, password mining, or any other means. Without proper authorisation, you must not probe, scan, or test a system or network's vulnerability or breach security or authentication measures.
•    Interference with Service Operation: You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the service or any activities conducted on the service. This includes any action that imposes an unreasonable or disproportionately large load on the service's infrastructure.

Users agree to pay all fees associated with their use of POLappka services, including but not limited to posting ads. Payment of fees must be completed using the methods provided within the service. By completing a transaction, you confirm that you are authorised to use the provided payment method and that all payment information you provide is accurate and truthful.
"Long Neck Family Labs" reserves the right to update the fee structure at any time, including introducing or adjusting new fees. Any changes to the fee structure will be communicated to users through the POLappka platform or via email to the address associated with the user's account.

All payments made on the POLappka platform are subject to our refund policy. Generally, payments made for posting advertisements or accessing premium features are non-refundable. This policy is in place to ensure the sustainability and continued development of the POLappka services.

In cases where a user believes they are entitled to a refund due to issues such as service non-delivery, unauthorised charges, or non-compliance with our advertised service standards, the user is encouraged to contact our customer support team to submit a refund request. Refunds, when granted, will be processed as promptly as possible and credited to the original payment method. Users will be notified of the decision regarding their refund request via email.

3.    A precise description of where the allegedly infringing material is located on the POLappka platform, sufficient for us to find the material;
4.    Contact information of the complainant, including address, telephone number, and email address;
5.    A statement by the complainant that there is a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
6.    A statement, made under penalty of perjury, that the information in the notification is accurate and that the complainant is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
8.2. Procedure Following Receipt of an Infringement Notice
Upon receiving a valid notice of alleged copyright infringement, Long Neck Family Labs will promptly take action to remove or restrict access to the content in question. We will also notify the content provider, member, or user about removing or limiting access, allowing them to respond.
8.3. Counter-Notice and Restoration of Content
Content providers, members, or users who receive notification of content removal but believe that their content was removed or disabled by mistake or misidentification may submit a counter-notice. This counter-notice must include:
1.    Their physical or electronic signature;
2.    Identification of the content that has been removed or disabled and the location where the content appeared before its removal or disabling;
3.    A statement under penalty of perjury that they have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
4.    Their name, address, and telephone number, with a statement consenting to the jurisdiction of the UK courts for the judicial district in which the address is located, or if outside the UK, for any judicial district in which Long Neck Family Labs may be found, agreeing to accept service of process from the person who provided the initial notification of infringement.
Upon receipt of a valid counter-notice, Long Neck Family Labs will forward it to the original complainant. Suppose the complainant needs to notify us within ten business days of their intention to seek a court order to prevent further infringement of the content in question. We may restore or cease disabling access to the removed content in that case.

8.1.    Arbitration Agreement
By agreeing to these Terms and Conditions, you and "Long Neck Family Labs" agree that any disputes or claims relating in any way to your use of the POLappka service, including but not limited to any advertisements posted through the service, will be resolved through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify and so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis.
8.2.    Arbitration Procedures
A neutral arbitrator will conduct the arbitration using the Arbitration Act 1996 (or any successor legislation), as amended occasionally, and applicable arbitration rules. The arbitration will be conducted in English and at a mutually agreeable location in England and Wales. If we cannot agree on a location, the arbitration will occur in London, England.
The arbitrator will have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. The arbitration decision will be final and binding on the parties, and the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
8.3.    Exclusions from Arbitration
It's important to note that certain types of disputes are excluded from this arbitration agreement. This agreement does not prohibit either party from seeking remedies in small claims court for disputes or claims within the jurisdictional limits of small claims court. Furthermore, this arbitration agreement does not prevent either party from seeking injunctive or other equitable relief from a court for matters related to data security, intellectual property, or unauthorised access to the service.
8.4.    Waiver of Class or Consolidated Actions
All arbitrations under these Terms and Conditions shall be conducted individually. Class arbitrations and class actions are not permitted, and by agreeing to these Terms and Conditions, you are waiving your right to participate in a class action. This waiver applies to class arbitration, and unless we agree otherwise, the arbitrator may not consolidate more than one person’s claims.
